Ada businessman Nathan Dial filed suit against the city for annexing the property as suburban district (A-2) after Pontotoc County commissioners rezoned the property as general commercial (C-2).
Dial wishes to build a for-profit auto/bus repair barn on the property.
Through his Seminole attorney Jack Cadenhead, Dial seeks to stop the city from "enacting any ordinance or law seeking to restrict (his) use of the property as previously authorized by county commissioners" prior to the city's annexation.
He also is seeking $10,000 in damages in addition to fees for his attorney.
Dial sued the county over the same issue but dropped his suit when the zoning was changed.
