Judge lifts restraining order in zoning dispute

Ada —  

District Judge Tom Landrith lifted a temporary restraining order Thursday blocking the Pontotoc County Commission from acting on a rezoning request for property along Stonecipher Boulevard.

Landrith said the county commission may consider landowner Nathan Dial’s earlier request to rezone part of his property, which dates back to October 2011. He also said the restraining order did not apply to Dial’s current request, which has not gone before the county commission yet.

However, the judge said he will not rule on any other issues concerning a lawsuit over Dial’s second zoning request until Jan. 28.

Thursday’s hearing was the latest twist in Dial’s long-running fight to get the county to rezone his property from a suburban to a commercial district. Dial is seeking the zoning change so he can build an auto repair shop on the property, located on the west end of the paved segment of Stonecipher Boulevard.
